Applicability and scope

These General Terms and Conditions (GTC) apply to the sale of our products and to the installation services agreed with us for end customers. The contracting party is TRATSON AG (hereinafter “TRATSON”, “we”, “us” or “our”). End customers purchase our products for their own use and not for commercial resale. Consumers are natural persons acting outside their trade, business, craft or profession. Resellers are subject to the reseller terms agreed separately.

These GTC cover, in particular, ENK-01 Quattro Power, ENK-02 Quattro Power, ENK-03 Quattro Power, ENK-04 Quattro Power, ENK Duo Power, ZFA-01 Quattro Power and ZFA-02 Quattro Power, together with the related accessories, spare parts and filter cartridges. The special terms of the satisfaction guarantee in section 9 and of the manufacturer’s warranty in section 10 apply exclusively to the extent described in those sections.

These GTC apply to deliveries and services agreed with TRATSON for end customers in Switzerland and abroad. ZFA Quattro Power and the related filter cartridges are sold exclusively in Switzerland and delivered within Switzerland. Deliveries of other products to a particular country require our acceptance of the corresponding contract. Any special country-specific terms agreed take precedence for the contract concerned. Mandatory consumer rights under the applicable law remain unaffected.

Our registered office and contact details:

TRATSON AG
Mellingerstrasse 19
CH-5413 Birmenstorf
Telephone +41 (0)44 212 22 31
E-mail: info@tratson.ch

Individual agreements concluded with you take precedence over these GTC. Mutual confirmation in text form, in particular by email, is sufficient for such agreements unless the law mandatorily requires a particular form. A unilateral request by the customer does not change the agreed terms.

The requirements for the satisfaction guarantee and the manufacturer’s warranty are set out in these GTC. For each product group, the satisfaction guarantee terms and the installation record form a two-page document. Returning both pages fully completed, signed by the owner with the place and date, together with the required photographs in accordance with section 9.2, is a condition of the voluntary satisfaction guarantee. A signature on page 2 expressly covers the guarantee terms on page 1 and the installation record on page 2; either a German or a French version is sufficient. The ENK document applies to ENK Quattro Power and ENK Duo Power, and the separate ZFA document applies to ZFA Quattro Power. The operating and installation instructions govern installation, safety, operation and maintenance. Different individual agreements remain reserved.

The version of these GTC made available to the customer before the customer places a binding order applies to that order. Amendments apply to future contracts; subsequent publication on our website does not change existing contracts.

Before placing a binding order, you have the opportunity to read and save these GTC and the special terms applicable to your order. By placing your order, you confirm their incorporation into the contract, that you are entitled to enter into the contract and that you are at least 18 years old. If you order on behalf of another person or organisation, you confirm your authority to represent them. Information on data protection is available at https://tratson.ch/en/data-protection/.

2. Conclusion of a purchase contract

The presentation of our products on the website, in brochures and in other advertising materials is generally an invitation to place an order and does not yet constitute a binding contractual offer. The agreed offer, the order confirmation and the product information incorporated into them are authoritative. Individual offers remain binding for the period stated in them. Changes to the product range, prices and product descriptions apply to future orders; characteristics and services already agreed remain binding.

You may place binding orders by telephone, in person, by email, SMS, letter or through our online ordering process. A mere request for an offer or brochure is not an order. Before submitting an online order, you can check and correct the order details.

We acknowledge receipt of an electronic order electronically without delay. This acknowledgement also constitutes acceptance of your order only if it expressly states this. Together with the order confirmation, you receive the essential contractual details and the agreed version of the GTC in a form that can be saved. For orders placed by telephone or in person, we provide the terms before the contract becomes binding.

Until acceptance, we may reject an order for objective reasons, in particular lack of availability, unauthorised payment or reasonable suspicion of abuse. We inform you without delay and refund without delay any payments already received for orders that have not been accepted. After conclusion of the contract, impediments to delivery and termination of the contract are governed by sections 3 and 7.

A binding purchase contract is concluded upon our express order confirmation in text form. If we have already submitted a binding individual offer to you, the contract is concluded when you accept that offer within the stated period and without changes.

Purchases for commercial distribution or resale require a separate agreement with us. These end-customer GTC do not grant any distribution rights.

3. Availability and reservation of performance for unavailable products

Information on availability and delivery times is indicative unless we expressly agree a binding date. Delivery delays are governed by sections 7 and 12; mandatory statutory rights remain reserved.

If, before accepting your order, we discover that a product is unavailable, we inform you without delay. We refund payments already made for orders that have not been accepted. If a product already ordered and confirmed subsequently becomes unavailable, section 7 applies.

We notify you of any quantity restrictions before accepting the order. An order already accepted may be changed only by mutual agreement or on the basis of a statutory entitlement.

4. Installation and operation

When purchasing directly from TRATSON, you may install the device yourself, engage your own specialist contractor or order installation by a specialist partner engaged by TRATSON. Every installation requires compliance with the instructions for the model concerned, the necessary technical knowledge and compliance with local regulations. Work reserved for an authorised specialist contractor may be performed only by such a contractor. Where installation is ordered through TRATSON, we engage the specialist partner. The scope of services and the flat-rate installation charge are set out in the specific offer or order confirmation. Installation costs are not included in the device price unless otherwise stated in the offer. For installation commissioned through TRATSON, TRATSON invoices the agreed flat-rate installation charge. For purchases on invoice in Switzerland, installation costs payable to TRATSON must be paid within 30 days of the invoice date. Deliveries abroad require full payment in advance.

Additional work and materials not included in the flat-rate installation charge, such as installing an electrical socket or adapting water pipes, are agreed with you in terms of scope and cost before the work is carried out and are invoiced directly by the specialist partner performing the work. The installation location must be accessible and suitable for the agreed installation. Necessary consents from owners or competent authorities must be obtained in good time.

If you directly engage your own installation contractor, the installation contract is concluded with that contractor. That contractor is your contact for the services it independently owes you. TRATSON’s own obligations remain unaffected. If the entire order is expressly handed over to an independent distribution partner before conclusion of the contract and you conclude the purchase and installation contract with that partner, that partner is your seller and contracting party for the installation and invoices the entire order. In that case, these GTC do not establish a purchase or installation contract with TRATSON. Transfer of a contract already concluded with TRATSON requires the necessary consent. Separately granted manufacturer’s warranties and mandatory statutory claims against TRATSON remain unaffected. Liability relating to specialist partners engaged by TRATSON is governed by section 12.

For all models, the supplied operating and installation instructions and any site-specific installation proposal approved by us must be followed. The devices are intended for stationary operation in dry indoor areas. Information on the power supply unit, coils, minimum clearances, environmental conditions and permissible settings is provided in the documentation for the model concerned.

For ZFA Quattro Power, the additional installation and operating requirements in the instructions for the model supplied also apply. The system is intended for cold water; the documented maximum operating pressure is 4 bar. Water and ambient temperatures, connection, pressure regulation, installation location, bypass and commissioning are governed by the technical documentation for the model concerned. Filter allocation, water routing, venting and flushing must be carried out in accordance with the instructions.

The ZFA filter cartridges must be replaced when the water-consumption limits specified in the operating instructions for the model concerned are reached, but no later than after twelve months; earlier replacement is required in the event of a high contaminant load in the water or reduced flow rate. Replacement cartridges and maintenance work are chargeable unless expressly included in the offer. Maintenance work must be carried out in accordance with the instructions with the system depressurised. In the event of leaks or safety-related malfunctions, the system must be taken out of service in accordance with the instructions and the fault investigated by a suitably qualified person.

5. Prices and shipping costs

For deliveries within Switzerland, the stated end-customer prices include statutory value added tax. We bear shipping costs within Switzerland. The total price agreed for the relevant destination country includes the product price and the agreed transport costs, customs duties and customs clearance charges. Applicable taxes, in particular import VAT, and their inclusion in the total price are expressly stated in the offer before conclusion of the contract. Any further import costs to be borne by the buyer must be expressly stated before conclusion of the contract; costs already included in the total price are not charged again. For deliveries abroad, the buyer is intended to act as the importer in the destination country. The transport or customs service provider engaged by us handles customs clearance under the form of representation agreed for the specific import. The buyer provides the required information and, where necessary, powers of attorney. TRATSON’s agreed assumption of costs does not change the allocation of roles under customs law. Mandatory statutory responsibilities remain unaffected.

By placing your binding order, you agree to the total price previously stated. A subsequent price change requires a separate agreement, for example for additional services requested.

We may change our prices for future orders. The agreed prices apply to your order; any agreed binding offer period remains reserved.

6. Payment terms and credit checks

For delivery within Switzerland and payment on invoice, the payment period is 30 days from the invoice date unless otherwise agreed before conclusion of the contract. For orders from outside Switzerland, the entire invoice amount must be paid in advance; dispatch takes place after receipt of full payment. An agreed satisfaction guarantee does not defer the payment obligation.

Available payment methods are displayed or agreed before the order is placed. We may make payment on invoice subject to a legally permissible credit check. Only the personal data necessary for this purpose are processed in accordance with our privacy policy and, where applicable, transmitted to the service providers described there. We agree any different payment terms before conclusion of the contract.

By selecting the payment method, you authorise the agreed payment. We may pass on costs arising from an unjustified chargeback for which you are responsible, to the extent actually incurred and legally permissible. Legitimate rights to dispute a payment or request a refund remain unaffected. Fees charged by your bank or payment service provider are governed by your agreement with them.

We or the payment service provider used may verify the validity and authorisation of the payment method. If a payment is declined, we contact you. Before conclusion of the contract, we may reject the order; after conclusion of the contract, suspension of performance and termination of the contract are governed by the agreed terms and applicable law.

For payment on invoice, the customer receives the invoice with a payment slip together with delivery of the goods or by email. Payment must be made using the payment slip within the period stated on the invoice. If payment is not made on time, Tratson AG is entitled to charge CHF 50 for its expenses for each reminder, together with further debt collection costs and statutory default interest. If it becomes necessary to initiate formal debt enforcement proceedings, we charge an additional processing fee of CHF 200.

7. Delivery terms

Delivery is carried out by a shipping service provider engaged by us. For deliveries to destination countries other than Switzerland and EU countries, the shipping service provider is specified in the offer. We bear shipping costs within Switzerland; for deliveries abroad, the agreed total price under section 5 applies.

For products available from stock, the estimated delivery time is 7 to 14 working days, depending on the destination, from conclusion of the contract or, where advance payment is agreed, from receipt of full payment. Any different delivery date is agreed before conclusion of the contract. Filter cartridges and other components of a ZFA may be delivered in separate parcels in accordance with the offer or instructions.

We inform you of foreseeable delivery delays and the expected further course of events. Once we are in default, you may set us a reasonable additional period for performance and, if that period expires without performance, exercise your statutory rights. Cases in which no additional period is required remain reserved. Section 12 applies to damages.

If delivery becomes permanently impossible or the contract is validly terminated, we refund without delay payments received for services or goods not provided. For temporary events beyond our control, section 12 additionally applies.

If delivery of the product fails due to the customer’s fault, Tratson AG is entitled to withdraw from the contract. Any payments made are refunded after deduction of a flat-rate expense charge of at least CHF 50.

If TRATSON voluntarily accepts the return of unused, not yet installed products at the customer’s request, a flat-rate processing and restocking charge of CHF 50 per return shipment is deducted from the refund. It covers administrative reversal of the transaction, inspection and restocking. When a ZFA Quattro Power is returned, these services are already included in the CHF 600 flat-rate charge under section 9.4; the CHF 50 charge is not applied in addition. This provision alone does not establish a right to early acceptance of a return. Separately ordered filter cartridges are not accepted for voluntary return. The charge does not apply where a mandatory statutory right of withdrawal is exercised or where the transaction is reversed on the basis of justified defect claims.

Unless mandatory statutory provisions provide otherwise, the risk of accidental loss and accidental damage passes to the buyer when the properly packaged goods are handed over to the transport company.

For consumer contracts subject to mandatory EU consumer protection law, this risk passes only when the buyer or a third party designated by the buyer, other than the carrier, takes possession of the goods. Earlier transfer of risk applies only where the buyer independently engages a carrier not offered by TRATSON and the statutory requirements are met.

8. Retention of title

We retain title to delivered products until payment has been made in full. Where necessary for the retention of title to be effective, we are entitled to register it at our expense with the competent register. You cooperate by providing the information required for this purpose. Mandatory statutory provisions remain reserved.

9. Voluntary 365-day satisfaction guarantee

9.1 Scope and return deadline

For ENK Quattro Power, ENK Duo Power and ZFA Quattro Power purchased directly from TRATSON AG, we grant consumers a voluntary satisfaction guarantee on the following terms. It begins exclusively on the invoice date and ends after 365 days. Later installation shifts neither the beginning nor the end of this period. To meet the return deadline, the returned device must actually be handed over to the shipping service provider no later than the last day of this period. Proof may consist, in particular, of a postal receipt or an acceptance confirmation showing the date and tracking number. Creating a shipping label or merely announcing a return is insufficient. The device may reach us after the 365 days have expired. For returns in person, actual handover to us must take place within the period. Property management companies, business users purchasing for their own use and resellers are not entitled to the voluntary satisfaction guarantee unless we have expressly agreed otherwise in the individual case.

Please enclose with the return an unambiguous statement that you are claiming under the satisfaction guarantee and details enabling us to identify your order. The form at the end of these GTC may be used for this purpose; no reason is required. Prior contact facilitates processing but is not an additional condition. You bear the costs and transport risk of the return shipment. Package the device safely for transport, using the original packaging if possible, and retain proof of dispatch. Registered shipping is not required. The optional return form does not replace the signed guarantee and installation document that must be submitted within the period specified in section 9.2.

9.2 Requirements

The invoice was paid within the agreed payment period; for purchases on invoice in Switzerland, this is generally 30 days, while deliveries abroad require full payment in advance. The device was installed within 30 days of the invoice date, operated for its intended purpose and in accordance with the instructions or an installation proposal approved by us, and tested for at least 90 days from installation. Where a device has a factory-applied display protection film, that film must remain intact on the display. Removing it immediately terminates the voluntary satisfaction guarantee, even if the display is undamaged. Removal alone affects neither statutory rights in respect of defects nor the separate manufacturer’s warranty.

The installation was documented using the fully completed installation record. The complete two-page guarantee and installation document for the relevant product group was signed on page 2 by the owner, with the place and date. The signature expressly covers the guarantee terms on page 1 and the installation record on page 2. Both pages of a German or French version, together with informative photographs of the installed device and the coils, must be posted or transmitted electronically to us no later than 14 days after installation. For a ZFA, the photographs must additionally show the water connections and the bypass. For postal submission, proof of posting within the period is sufficient; for electronic submission, receipt by us within the period is required. A legible scan or legible photographs of both pages bearing the signature are sufficient for submission by email.

If installation is delayed for a reason for which we or an installation partner acting on our behalf are responsible, this does not result in loss of the satisfaction guarantee. We agree adjusted installation and record-submission deadlines with you in text form. If, because of such a delay, 90 test days are no longer possible within the 365-day period, the minimum test period is shortened accordingly. The return period of 365 days from the invoice date remains unchanged; later installation does not extend it.

The voluntary satisfaction guarantee applies to the original buyer and is not transferable. It ends upon a transfer of ownership. Statutory rights in respect of defects and the manufacturer’s warranty under section 10 remain unaffected.

9.3 Return address

TRATSON AG
Mellingerstrasse 19
CH-5413 Birmenstorf
Telephone +41 (0)44 212 22 31
E-mail: info@tratson.ch

9.4 Refund and condition of the goods

In the event of a voluntary return that complies with the terms, we refund the amount paid, less the agreed return charges, within a maximum of eight weeks from receipt of the goods by TRATSON. The refund is paid into a bank account specified by the buyer. Please ensure that you provide us with the correct account details and have access to the specified account; TRATSON accepts no responsibility for any lack of access to your account.

Normal signs of use arising from testing the device for its intended purpose do not result in a deduction. For ENK devices, these include, in particular, normal installation marks on the plastic side plates, and screws, fixings and coil cables used for their intended purpose, even if these parts need to be replaced after return. For damage for which the buyer is responsible beyond these normal signs of use, in particular scratches on the anodised aluminium housing or cracks in the display glass, and for missing parts, the reasonable and necessary repair or replacement costs are deducted from the refund. Double charging is excluded; work and parts already included in the ZFA flat-rate charge are not charged again. The refund may be reduced to zero only where the damage is correspondingly high. The separate requirement concerning the display protection film under section 9.2 remains in force. We may withhold the refund until the goods have actually been returned to us. Mandatory statutory rights to reversal of the transaction remain unaffected.

If a ZFA Quattro Power is returned under the voluntary satisfaction guarantee or a separately agreed voluntary return arrangement, a flat-rate charge of CHF 600 is deducted from the purchase price. It covers outbound shipping, administrative reversal of the transaction, unpacking and dismantling, inspection including a further pressure test, repackaging and restocking and, where applicable, non-reusable filter cartridges. No additional flat-rate processing and restocking charge of CHF 50 is applied. The charge applies regardless of the actual period of use, including voluntary returns before installation or commissioning.

The customer additionally bears the full cost of return shipping. Installation and removal costs are not refunded. The system must be properly drained and packaged safely for transport. The CHF 600 charge does not apply where a mandatory statutory right of withdrawal is exercised or where the transaction is reversed on the basis of justified defect claims.

If your purchase was referred by a customer and TRATSON credited or paid that referring customer a bonus of CHF 100 for it, that amount is deducted from your refund in the event of your voluntary return. This also applies if you did not receive the bonus yourself. The deduction is expressly disclosed to you in the offer before conclusion of the contract and shown in the return statement.

The deduction does not apply to the extent that the referral bonus has been cancelled or repaid. No referral bonus deduction is made where a mandatory statutory right of withdrawal is exercised or where the transaction is reversed on the basis of justified defect claims.

9.5 Exceptions and non-refundable services

Products individually manufactured to customer specifications are excluded from the voluntary satisfaction guarantee if this exclusion was expressly agreed before conclusion of the contract. Merely selecting a standard model, making a normal device setting or providing a site-specific installation proposal does not turn a standard device into such a custom-made product. Separately ordered filter cartridges are entirely excluded from the voluntary satisfaction guarantee and voluntary returns. This also applies to unused, unopened and originally sealed cartridges. Statutory defect claims and mandatory statutory rights of withdrawal remain unaffected. Return of a complete ZFA under the voluntary satisfaction guarantee is governed by the terms agreed for that purpose and the CHF 600 charge; use of the supplied cartridges for this testing purpose does not prevent such a return.

Installation, removal, return shipping and other additional services commissioned by the customer are not refunded under the voluntary satisfaction guarantee. Payment of agreed installation costs is subject to the payment periods under sections 4 and 6. Claims arising from defective installation services and mandatory statutory rights to reversal of the transaction remain reserved.

9.6 Statutory rights of withdrawal

Mandatory statutory rights of withdrawal, in particular for certain telephone and doorstep transactions under Swiss law or for consumer contracts subject to applicable foreign law, exist independently of the voluntary satisfaction guarantee. Statutory rights in respect of defects and the separate manufacturer’s warranty under section 10 also exist independently of the voluntary satisfaction guarantee. The conditions in sections 9.1 to 9.5, in particular the minimum test period, installation record, display film, payment period and flat-rate charges, do not restrict these rights. Statutory withdrawal is governed by the statutory time limits, formal requirements and legal consequences and by any separately provided withdrawal information.

10. Rights in respect of defects and manufacturer’s warranty

10.1 Inspection and notification of defects

Please check delivered products on receipt for correctness, completeness and visible damage. Visible defects must be reported to us within five working days; defects identified later must be reported without delay after discovery. Email is sufficient. Where mandatory law provides longer periods or does not make rights conditional on such notification, it takes precedence. In particular, the statutory period of 60 days applies to defects covered by Article 201(4) of the Swiss Code of Obligations (CO) and by Articles 367(1bis) and 370(4) CO. Late notification results in a loss of rights only to the extent permitted by applicable law and the terms validly agreed.

10.2 Contractual rights in respect of defects

We are liable for defects for which we are responsible under the contract and applicable law, in particular the absence of agreed characteristics. Defect claims generally become time-barred two years after delivery. Longer statutory periods that apply, in particular five years where the requirements of Article 210(2) or Article 371 CO are met, remain fully applicable. The additional manufacturer’s warranties under section 10.3 exist independently of these rights.

For a justified defect claim, we initially provide repair or replacement free of charge, at our option. Any mandatory customer rights to choose the remedy and obtain repair remain reserved. If both remedies are impossible, refused, have definitively failed or have not been provided despite a reasonable period, the customer has the further statutory remedies for defects. Mandatory rights to rectification of construction defects free of charge remain unaffected. Section 12 applies to damages.

10.3 Additional manufacturer’s warranty

The relevant manufacturer’s warranty begins on the invoice date or the installation date, whichever is earlier. Performance under the warranty does not extend this voluntary warranty period; for replaced parts, it continues until the end of the original warranty period. This does not restrict the statutory rules on limitation periods, their interruption or mandatory rights in respect of defects.

TRATSON AG grants the following manufacturer’s warranties for defects in materials and manufacture: ten years for ENK-01 to ENK-04 Quattro Power; five years for ENK Duo Power; two years for the ZFA Quattro Power filtration system, excluding filter cartridges. The ten-year ENK manufacturer’s warranty applies to an ENK Quattro Power integrated into a ZFA. Subject to this cartridge exclusion, the warranty covers the parts of the device concerned and their repair or replacement at our option. Normal wear and the depletion of filter cartridges through their intended use are not defects in materials or manufacture. Statutory rights in respect of defects in filter cartridges remain unaffected.

Under the voluntary manufacturer’s warranty, you bear the cost of sending in the device or the parts agreed with us. Repair or replacement, including the associated workshop labour, is carried out without charge. Costs for on-site attendance, removal, reinstallation or travel are included only if expressly agreed. For statutory or contractual rights in respect of defects under section 10.2, the applicable allocation of costs remains in force; it is not restricted by the above rule concerning the additional warranty. Replaced parts become our property.

The manufacturer’s warranty requires proper installation and operation for the intended purpose in accordance with the agreed product documentation. Damage is not covered to the extent that it is caused by improper interventions, faulty installation, failure to carry out necessary maintenance, impermissible operating conditions or external influences. Examples include water entering the electronics, impermissible temperatures or impermissible ZFA operating pressure. Removing a display protection film does not, in itself, result in loss of rights in respect of defects or of the manufacturer’s warranty; section 9.2 applies to the voluntary satisfaction guarantee.

10.4 Procedure

To report defects or raise service enquiries, contact us with the invoice or order number, a description of the fault and, where appropriate, informative photographs. Other suitable proof of purchase is sufficient if the invoice is no longer available. Our contact address is:

TRATSON AG
Mellingerstrasse 19
CH-5413 Birmenstorf
E-mail: info@tratson.ch

Please arrange the return with us in advance where possible so that we can determine whether the whole device or only a component needs to be sent in. Timely notification of a defect must not be made conditional on prior return authorisation. Package the goods safely for transport and retain proof of dispatch. Allocation of costs and risk depends on the claim being made and applicable law; no blanket forfeiture of all claims solely because of loss in transit is agreed.

Before commissioning third parties to carry out investigations, repairs or replacements at TRATSON’s expense in connection with a complaint, you must give us an opportunity to inspect the matter and carry out any repair or replacement owed, insofar as this is reasonable in the circumstances. Independently engaging a third party does not, in itself, establish an obligation for TRATSON to bear the costs. Necessary immediate measures to prevent imminent damage and statutory rights to reimbursement of costs, in particular after a required additional period has expired without remedy, remain reserved.

11. Complaints and grievances

We place great importance on customer satisfaction. You can reach us using the contact details provided at the beginning of this document. We endeavour to examine your enquiries and complaints as quickly as possible and will contact you after receiving the documents, your submission or your complaint. If you have a complaint or grievance, please assist us by providing an accurate description of the problem or fault symptoms and, where applicable, a copy of the invoice or at least your customer number. We endeavour to respond within 10 working days.

12. Product characteristics and liability

The ENK limescale protection devices and the ENK limescale protection component of a ZFA serve to influence the deposition behaviour of minerals contained in the water. This process does not remove calcium or magnesium from the water. The agreed performance is determined by the relevant offer and the product documentation incorporated into it.

Unless a more extensive characteristic has been agreed or mandatory law provides otherwise, neither complete prevention of new limescale deposits nor complete removal of existing deposits is assured. This applies in particular to pipes, water heaters, heat exchangers, fittings, surfaces and household appliances. Nor is any specific quantity of deposits removed, specific time period or extension of the service life of an existing system assured. The result at an individual property depends, among other things, on the water composition, pipe routing, condition of the existing installation and manner of operation.

Purchase of the device does not include any examination, condition assessment, refurbishment or renewal of existing domestic installations and connected appliances unless such services have been separately agreed. Without a special agreement, recommending a device or assessing submitted photographs and information does not constitute confirmation that existing systems are free from deposits, corrosion, material fatigue, leaks or other pre-existing damage.

Recommendations on device selection and sizing are based on the information you provide about the property, its use and the installation. Information requested by us and known to you must be supplied correctly and completely; identifiable uncertainties must be disclosed. We are liable for adverse consequences attributable to incorrect or incomplete information only to the extent that we are responsible for them under the applicable liability rules.

The operator remains responsible for the care, inspection, cleaning, descaling and maintenance of the domestic installation and household appliances required by the respective manufacturers’ instructions. Using a TRATSON device does not replace this work. Household appliance settings, in particular water hardness settings, must be made in accordance with their manufacturers’ instructions. The pre-existing situation at the property and the necessary maintenance work must also be taken into account during the test period.

TRATSON does not bear the costs of examining, cleaning, descaling, repairing or renewing existing systems merely because a limescale protection device has been purchased or operated. TRATSON accepts no responsibility for pre-existing damage or a need for refurbishment that exists independently of any service provided by TRATSON, to the extent that TRATSON is not responsible for it and no corresponding service has been agreed. Whether and to what extent TRATSON is liable for an aggravation or additional damage for which it is responsible is determined by the following liability provisions and applicable law. Pre-existing damage and expenses that would have been necessary in any event must be taken into account when determining recoverable damage in accordance with the statutory rules.

For contracts governed by Swiss liability law without conflicting mandatory foreign consumer law, TRATSON is liable for unlawful intent and gross negligence. Liability for slight and moderate negligence is excluded. This also covers indirect damage, consequential damage, loss of profit and loss of use. Contractual liability for auxiliaries and independent specialist contractors engaged is excluded within the framework of Article 101 CO, irrespective of their degree of fault. Mandatory statutory responsibilities remain reserved.

These exclusions do not apply to death, bodily injury or damage to health culpably caused by TRATSON, nor to mandatory liability, in particular under applicable product liability law. The return, repair and replacement services promised in these GTC and mandatory rights in respect of defects remain unaffected.

For consumer contracts subject to mandatory foreign consumer law, the above Swiss exclusions of liability do not apply. For these contracts, liability is governed by the applicable statutory provisions and any special country-specific terms validly agreed.

The filtration performance of a ZFA is determined by the agreed characteristics of the installed filter cartridges and the intended operating conditions. No independent guarantee is given for permanent freedom from germs, removal of every conceivable contaminant or particular suitability of the water for an individual person’s health needs. No disinfection, sterilisation or medical service is owed. No particular degree of purity or particular composition of the treated water is assured.

TRATSON accepts no liability for adverse effects attributable exclusively to contamination of the incoming water or domestic installation for which TRATSON is not responsible, operation outside the agreed operating limits or failure to follow technically necessary maintenance and hygiene requirements that have been properly communicated. The statutory allocation of the burden of proof remains unaffected. This provision does not exclude liability for defects in the product, its design or its operating instructions to the extent that liability arises under the applicable liability rules.

In the event of identifiable malfunctions or imminent damage, measures to limit damage that are reasonable in the circumstances and can be taken safely must be implemented in accordance with the instructions for the model concerned. TRATSON must be informed without avoidable delay; necessary immediate measures must not be delayed as a result. A culpable breach of the duty to mitigate damage is taken into account when assessing damages under applicable law, to the extent that it contributed to the occurrence or increase of the damage. Statutory rules on the burden of proof remain unaffected.

Events beyond our control

In the event of circumstances beyond our control for which we are not responsible and which we cannot prevent despite reasonable precautions, performance periods may be extended for the duration of the impediment. This applies only to the extent that the event actually prevents or delays the relevant performance.

Such events may include, in particular, natural disasters, war, government measures, epidemics, pandemics, strikes by third parties or substantial failures of transport and supply networks.

We inform you as soon as possible of the cause and expected duration of such an impediment. In the event of prolonged or permanent impediments to delivery, your statutory rights and refunds for services or goods not provided under section 7 remain reserved.

13. Data protection and use of installation photographs

We process personal data in accordance with the applicable data protection provisions. Information on the purposes, recipients and further details of processing, and on your rights, is available in our privacy policy at https://tratson.ch/en/data-protection/. We use the installation record and submitted photographs to check the installation and to administer the contract and warranties.

By submitting installation photographs, you grant TRATSON a royalty-free, non-exclusive right, unlimited in territory and time, to publish them on its own website as installation examples and to advertise its products. This includes the storage, reproduction and technical editing required for that purpose, in particular cropping, resizing and removal of identifying information. Publication may take place without naming the author and without further consultation. TRATSON may use service providers engaged for this purpose.

Publication takes place exclusively in a version that does not enable individuals to be identified or the images to be linked to a particular customer. You confirm that you took the photographs yourself or hold the rights required to grant these usage rights. Mandatory statutory rights remain reserved.

14. Copyright

The content published on our website and in our documents is protected by copyright and belongs to TRATSON AG or the respective rights holder. Storage and reproduction for your contractual records and for the intended use of the purchased product are permitted. Further exploitation requires the rights holder’s consent unless permitted by law.

15. Severability

If a provision of these GTC is invalid or unenforceable, the remaining provisions remain in force to the extent that the contract can continue without the provision concerned. The applicable statutory provisions take the place of the invalid provision. The same applies to gaps in the contract.

16. Applicable law and jurisdiction

The contract is governed by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory provisions of private international law and mandatory protective provisions applicable in favour of a consumer under the relevant conflict-of-laws rules remain reserved.

Consumer contracts are subject to the statutory rules on jurisdiction. In Switzerland, the consumer may generally bring proceedings at their place of residence or at TRATSON AG’s registered office; proceedings against the consumer must generally be brought at their place of residence. For other contracts, Baden, Canton of Aargau, Switzerland, is the agreed place of jurisdiction unless mandatory jurisdiction rules provide otherwise. Mandatory international jurisdiction rules remain reserved.

Form for return or statutory withdrawal

Use of this form is optional. Please indicate whether you are claiming under the satisfaction guarantee in section 9 or exercising a statutory right of withdrawal. For the voluntary satisfaction guarantee, sending this form does not replace actual handover of the parcel within the return period.
